A Grab Bag Of Halachos

The Gemara states that the sister of Rav Tovi bar Rav Masnah, while on her deathbed, signed away all of her property to him. Rav Achadvoi, Rav Tovi’s brother, complained to his sister: “If you give away all your property to Rav Tovi, people will murmur and say that Rav Tovi is a true rabbinical scholar and therefore received all the property while his brother Rav Achadvoi is not.” Whereupon the sister assigned all of her property to Rav Achadvoi.
Rav Elchanan Wasserman raises an obvious point. Now the same problem exists, but in reverse. Now everyone will say that Rav Achadvoi is a scholar while Rav Tovi is not. Perhaps, suggests Rav Elchanan, that is not Rav Achadvoi’s concern. He likens it to a situation where floodwaters are about to reach a person’s property. He erects barriers to prevent the floodwaters from wreaking havoc. Now the water will instead flood his neighbor’s property. His actions are justified, as he is allowed to act to prevent damage to his property, though this indirectly causes damage to his neighbor. Perhaps Rav Achadvoi is allowed to act to prevent his good name from being besmirched, even though this will indirectly harm his brother’s good name.
